Used lawbird and now have the NIE number and passport number
He seems to be in the house that we once owned together, but due to a bad consent order allowed the transfer before he paid me
In, theory Court orders obtained in one EU country can be enforced in another. Lawbird can guide you on it.
Has, he not got any Assets in the UK ????, You can place a charge on his assets in UK. Take legal advise as issues like above cannot be looked at in isolation.
Goinfg to see Uk solictor in afew days just wanted to get a feel for how complex and costly this was going to be
He sold the assets we owned jointly in UK for 150,000 and left without paying me , apart from the house in spain he is living in ( this was another assett I had to sign over due to a badly constructed consent order) I dont know where he has put the money he has got
Not sure if there is any way its possible to find out where he is holding money either in UK or spain
So the only asset I know about is the spanish property
Do you know if its possible to track down his bank accountS in spain/uk or both if I get a court order in the uk
If you know where he is have you confronted him? I can only see that you will go through a costly law case and get nothing, sounds too complex. Think about denouncing him for something or there is always the heavies!
Really sorry to hear your trouble, the real problem with Spain is the amount of time its takes to go to court, However a good lawyer can probably put an embargo on his properties but actually making him give you the money will be a long drawn out affair.
If it was in Andalucia i could recomend a brilliant lawyer but you need somone in Murcia.
I think someone else probably mentioned on here that you would best resolving it in a non legal way whatever that happens to be.
He may out of respite accept a lower amount, than pay you! If you are sure that the house belongs to him than urgently place an embargo on the house before you even start looking for a debt collector.
Further if there is a mortgage on the house, than let the lender know that you have an interest in the house on the basis of the court order/s that you have against him. You will have to take legal advise/lawyer to do this.
Once this is done you are protected. He either pays you now or later and until such time he cannot sell
