AIFOS wins court case…AGAIN!!

      In 2004 a British woman paid €157,200 to Aifos as deposit for 2 apartments. They were never built but the deposit was not returned. This week the Judge threw out the case because he said it wasn’t a crime as it had not been proved that AIFOS intend to deceive 👿 The client never received a bank guarantee (which is illegal!), neither did the money go into a client account. The Judge also pointed out that the purchasers intention was investment to gain income from said properties….you couldn’t make it up, what does this have to do with the law 😈

      Sounds like something that would happen in a Zimbabwe court 🙄

      Totally agree with you both, it beggars belief 👿

      Somehow Spain has got to get a grip with this sort of fraudulent outcome of Court cases, you just know the judge has had a bung, he only had to look at Aifos history to understand the case. If it’s at all possible this should be appealed even taken to Brussels 🙄

      It does confidence in Spain no good whatsoever, clean it up and confidence will start to rise but until then, no-one is safe from theft, not forgetting how long it all takes to end up losing 👿

      I think forum users are well aware of my views on Spain. However in this instance It was right for the judge to NOT to look at Aifos history. The Courts/Tribunals only focus on matters presented to them. This is a global practise.

      Wrong again!!! 😳 😳 😳 😳 😳 a bank guarantee is not obligatory; it is an option that a buyer can take out at their expense. Sometimes a developer will include a BG as part of the “deal”…. poor old Spain always getting blamed!!!!! 🙄 🙄 🙄 🙄 🙄 🙄 🙄 🙄

      That old saying ‘the law is an ass’ reminds me that way back in July 2007, charlie posted a link from Typically Spanish (not found now) that ‘Aifos has been shown to have bribed dozens of Judges, Notaries and property registrars etc’ So much anecdotal evidence to show the corruption as well as bribing the Judicial and property system etc! 🙄

      Goodstich (remember him?) said ‘Lets hope future cases against Aifos will be judged with an even hand’

      Ha, nearly 6 years later it seems past history could have been re-visited in this case, IMO Judge bribed again in this instance, forget what happens around the World, this is Spain, re-visit the crooked history and put a stop to these practices 😮 😯 😕 🙄 😡 🙄 😆
