I have today finally recieved my first instalment of £39k. I paid a deposit of £80k on Las Vistas almost 5 years ago. Next payment 90 days plus interest plus costs. Despite advice from this forum I stayed with ME. my lawyer Jacobo was slow but that is the system in Spain and always replied to emails. One happy man on this forum.
I am delighted for you!!! that is really great, you will be celebrating then? and also the fact that you have gotten your first payment will give hope to all the others on the forum that there is light at the end of the tunnel.

Re. ME – I think with all large law firms, it just depends which lawyer you have hence some good reports and some bad.
Can you inform us of the current situation with Las Vistas (Santa Maria Golf?).

Still not finished Charlie, just an eyesore no action, the building site deserted and no one will ever move in. The developers of Los Lagos have tried their best to make it look halve descent up there (green screening etc)
Word is they are coming down, hope so they look rubbish from the Golf Course.
Isn´t terrible that we should have to celebrate and congratulate someone for getting his/her money back, when it should be such an obvious matter and it should be without questioning 👿

Still, grateful for small mercies and all that.
Concerning other developments – with some judges now ruling that people have to complete despite no LFO and/or a current valid building licence, I fear there won’t be as many celebrating in the future as there should be.

On what law(s) are the judges basing their rulings.? Surely selling a property without permission, a licence or whatever is like selling a car without an engine or a gear box. I know the law is an ass , but if the judges can prove that their decisions are based on law rather than let us say a sweetener from unspecified sources then the law is truly an ass.

The law in not the ass in these cases, it’s the judges who are.
And they don’t have to prove anything – they just give their ruling, even if it does go against their own laws and basic human rights.
The building licence is suspended because the developer failed to build according to the PGOU and obtained the licence by bribing someone who is now in jail? “No problem. Complete and by the way, I order you to pay the developer’s legal fees while you’re at it”.
Don’t want to complete on a build with a suspended building licence that has no LFO? “No problem, I hereby state it has one via the Administrative Silence rule, so complete, that is my ruling! And HA! Don’t think you can take this to a higher court. As this is your appeal and the amount is under 150,000 euros you have no right to take this any further”.
Town Hall architect, as a witness, is saying “but we deem this an illegal build, there should only have been townhouses, not blocks of apartments. We have revoked the building licence and will not issue an LFO until we have a judicial review. It goes against the current PGOU until the new one is finalised”. “Look, I’m the judge here, you are wrong in my view so am disregarding anything you have to say”.
By law you should have had a Bank Guarantee which was never issued? “So what! As far as I’m concerned, this developer has not breached any contract”.
End of matter for the poor purchaser who has to complete now otherwise the developer can now sue him for …………………. breach of contract!
There are the laws to protect people during the puchasing process, but people’s rights within these laws are being abused in court in many cases such as the one above.
Nope it’s the top right hand, the block in terracotta under the right hand crane.
Bottom right is a Villa or apartments on the opposite site of the road of the golf course above the 15th green, near the “Balamory House” (Multi coloured paint and roof).
After over 4 years of fighting I have finally got my second instalment today into my bank. My Lawyers got me all the deposit (79k) plus interest and costs. Like all of you I kept fighting, its our money and belongs to us.

How long for no habitation licence 🙄
Even in Spain a no build is a no build and stunned that the legal profession/courts and judges took that amount of time to try to wriggle out of that one.

Las Vistas is not a no build. (See photo posted by Charlie on an earlier posting) I thought it was going to be demolished, at least some of it anyway. 😕

Yep know it well and yes it was started, soon stopped and informed years ago that its coming down
To me it amounts to a no build,sorry if my view caused confusion and happy to put the record straight.
Las Vista was started.stopped and Bank Guarantees should have paid out as this was really didnt have the go ahead 😉
Should never have taken over 4 years to sort and here is me saying that when I think its year 5 next year and not even a court date.
Las Vistas was a Moleon development (now owns Eralia/Greenhills?)and was one of the first to be cordoned off by the police at the start of the “Malaya” case. Another corrupt developer!
Great news to hear people don’t give up the fight against these s***e people and then go on to win their case …eventually!

Thank you Frank and Claire and all for the good wishes. just a note to say that when I found out that I did not even have a bank guarantee the notorious irish co who sold me the apartment stopped answering my calls. Then I was worried. But Jacobo at ME was good and got me the money. Keep fighting and we will all win.
