Is there anybody out there who is going through the distresses of the Spanish legal system? So far we have been waiting more than two years for justice through the criminal courts in Spain. This moment in time the Spanish promoter/builder and Swedish estate agents walk free. All I ask for is justice – can’t ask for more.
The good news is Claire and Charlie will receive their monies through their bank guarantee. Which is wonderful news for them but their developer refused to return their money. Our developer refused to return our money too that is why we have to go through the tedious Spanish legal system. We did not have a bank guarantee as we had a fraudulent contract. Every case is different

I think by the time we, (Barbara & us) actually GET our money, we will have another tale to tell! There we were thinking “Nice Snr judge has told the Bank to pay up, we’ll get our money within the week…………..and how many fingers are in the pie???????????…….” 😯 😯 😈
We should be very pleased (which we of course are)with the successful outcome of our situation. Even so, we have “lost ” approx £18,000. That is a lot of money. Compared to many, we are lucky though…we can see light at the end of a long, dark tunnel.
We didn’t “loose” the money. It is what it has cost us in interest on the original deposit as we put it on our mortgage “temporarily”( which many people have done) until we downsized here in the UK and put the equity in Spain. Thank goodness we didn’t sell our house, unlike Barbara! we were a month away from exchange/completion!!! On top of that we have the the lawyers fees which amount to approx £7,000.+ our costs going back & forth to Spain. Until we get our money we are still paying the mortgage. £ 18,000 is conservative.!! Also the exchange rate is c***!
Had we known that we were not going to get 6% that we were told we would get and that ALL the literature that we read says we should get, we would have financed the money in another way. The 6% should have covered the cost of the loan over the 3 years we have been paying it. 4% doesn’t do it!!! 🙁 Bear in mind we didn’t know whether we would EVER get our money back!!) It’s taken almost 18 months to get to this point.
