This post is specifically regarding Green Hills, Santa Maria Golf – but is of interest to anyone wanting an up-to-date status on their development in the Marbella area…….is this a new era of ‘Glasnost’ ?
This morning I telephoned the Planning Department at Marbella Town Hall. I wanted to see if I could get hold of a very helpful lady I met there in January, called Monica Anon, who back then was able to find out for me the current status on our development at Green Hills, Santa Maria Golf regarding our building licence.
I was passed to a lady who explained she was standing in for Monica while she is on holiday.
When I supplied her with Green Hill’s Building Licence number, she promptly and politely gave me an immediate update on Green Hills status. In Green Hill’s case she was able to tell me that there is no Licence of First Occupation (through the AS rule or otherewise), and that the decision to grant one is pending a judicial decision by the courts on the legality of the Building Licence. This, despite the developer insisting the development has a Licence of First Occupation through the Administrative Silence rule!
As this lady was so open and helpful, it occured to me that there is nothing to stop any others of you trying the same thing (Suzanne at La Reserva for example ??).
You will not find this magic Building Licence number on your contract or Bank Guarantee – but your lawyer will/should have it in his paperwork – unless you have your own copy of your Building Licence.
I spoke to the lady in Spanish and do not know if she speaks English (sorry…). But feel the ease in which I have (finally) found out this definitive information – after months and months of trying, and the developer consistently insisting on an LFO via the AS rule – the route I took may be of help to others.
