I would welcome advice please I work in the UK one week each month and my husband 2-3 weeks on average each month. We are currently both paying taxes in the UK, is this correct. We have a home in the UK and one in Spain. This arrangement began in August 2008 should I be applying for residency as I am likely to be here more than 180 days in a year and if so when should I do this. Would my husband have to apply for residency ?

      Thanks

“I work in the UK one week each month”

Does not matter how many days you work. Its depends on your tax domicile/residency.

“my husband 2-3 weeks on average each month”

See, above, For tax purposes you are two different individuals.

“We are currently both paying taxes in the UK, is this correct.”

      See above.

” We have a home in the UK and one in Spain.”

Does not matter, you can have homes all over the world.

“This arrangement began in August 2008 should I be applying for residency as I am likely to be here more than 180 days in a year “

It really depends on your circumstances, personal, financial. Your attitude towards paying taxes & the use of the taxes by the respective Government e.g if the Government is spending that tax revenue on improving the life of its Citizens or using your money bombing others, whilst being an accomplice in implementing others foreign policy.

“and if so when should I do this. Would my husband have to apply for residency ? “

It should be done if you intended to be in the the Country with a view or with the intention to be there for more than 183 days.

The above is a general view. You really need to speak to a tax expert who is a specialist in double taxation etc.
