Barbara & I ..and of course my husband 😉 have just recieved the news from our lawyer that we have won our case in the Madrid Court to have all of our interest paid + legal fees!
……….fantastic news, what a breath of fresh air, hearing justice done in spain, gives us all a bit of hope that it is possible if you get to the right people!
I think it was January that we first contacted him. I think it was around March that he took the first steps to prepare our case to present to the Court.
Our previous lawyer(second) achieved diddly squat in 6 months!!!!
As I posted on another thread (can’t find it!), Claire and my lawyer (Carlos) has been watching the forum this week.
He is so disenchanted with the justice you have received, he telephoned me this morning saying he is willing to look at your court’s resolution – and if he feels confident that an appeal is worthwhile he is happy to take you on as a client (if you would like….).
If mutually agreeable, and you do decide to go with Carlos, can confidently say you will have a good man on your side.

Hopefully this will permeate down the line and other successes will follow particularly for David who’s horrendous experience at the moment is unbelievable
Fantastic news! Just goes to show what can be done if you are determined enough and not willing to be bullied and told you have not got a hope in hell. Great to have such a great lawyer fighting for you too and also having other people in the same boat working together and supporting eachother. Talyhoo!

However, for me it is a bit of a sugared-pill, knowing that there are so many of you out there who are still in the middle of the nightmare Claire and I were once in.
We feel immensely lucky having found ourselves an excellent lawyer.
I know a lot has been written about lawyers on this forum recently, and yes we both had to change our ‘rotten’ lawyers that gave us such disservice at the beginning of our purchase.
I could sometimes weep at the stories sent me by pm’s where some people’s lawyers just ride roughshod over people’s legal rights and treat them with an attitude bordering on arrogance.
And why? Because their own greed and self-feeding interest has led to a level of corruption that we in the U.K. would hardly believe possible amongst the legal profession.
Now and then, maybe. But with so many huge developments in Spain, on one development alone a corrupt triangle of agent/lawyer/developer can affect hundreds of people. Times that by several developments and you are soon into the thousands. And as Mark says, all these people can be affected by a relatively small group of lawyers.
So I think the moral of our story is “seek and you shall find”!
Yes, there are corrupt, immoral lawyers out there, possibly predominantly on the CDS where there has been such massive development. But there are superb lawyers out there who take on the big boys like AIFOS (re. Dorothy’s post) and like our lawyer Carlos (he has also taken on AIFOS in the past and won 😉 ).
And there are lawyers like Drakan, Maria de Castro and Cesar who give their time on this forum to give free legal advice.
I know it is a minefield to find a good lawyer, and it is ‘pathetic’ when the Colegio de Abogados fails to act when a case is stuck under their nose where there has been blatant derelict of duty.
But if you get a good one the Spanish justice system in my view is probably as good as most other countries.
If your lawyer failed to get you a Bank Guarantee, get a new one.
If your lawyer abused your power of attorney and allowed for example an extension date on your contract without telling you, get a new one.
If your lawyer tells you that you’ll lose 50% of your deposit if you don’t complete despite there being no LFO, or tells you you don’t need a Bank Guarantee, or that you have to pay for one, or wont answer/return your phone calls or e-mails, etc. etc. etc. …….
….if you have any reservations about your lawyer – GET A NEW ONE.
Because without a good lawyer on your side, you will not get the justice you deserve.
To those currently in a nightmare situation, I wish you all a good resolution to your cases.
You must all be thrilled that this sage is over and justice has been done. Hope you will all continue to participate in the forum and continue to help us all with advice and your experiences

Thank you ALL for your up lifting messages. 🙂 It is a HUGE relief. 😀 There are still a few”loose ends” to tidy up, but the real “nightmare” can be laid to rest now.
As Dorothy said we have been very determined in our quest. What has helped us enormously, is that we did not go into this alone. We have had so much support from the Green Hills friends that we have met along the way., and from all on the forum. Their fight goes on but we will definitely be there to support and encourage them & you, to the end of what I hope will be a successful conclusion too.
Barbara & Katerina are brilliant. (they can type quicker than I can so hence their longer posts!! 🙂 ) My husband & I have been very fortunate to have them as our allies.
As Barbara said ,I believe the problems arise with certain lawyers, when the income generated for them from the developers is greater than it is from the clients they represent. They will not bite the hand that feeds them!
I’m now hoping that my brain will function a little better than it sometimes has now that I can clear space after all the turmoil! I live in hope!! 😆

Our situation has been on going for 5 years now when forums like these were not around. We are still waiting on the Malaga Colegio to let us have their formal decision in writing on our complaint against our ex lawyers for failing to ensure we had a bank guarantee. Perhaps we can then find out how on earth they managed to reverse their investigating officer’s decision against our ex-law firm. We were informed that Junta made the decision in July, despite frequent contact with their secretariat we still have no confirmation of their decision.
Claire, you may have noticed that our mutual ex-lawyer’s website has now ‘lost’ its page on staff members!
