It’s been a long time coming, but we have just received the news that our Lawyer , Carlos Comitre has AGAIN been succesful for us. We have won our case against the law firm we are suing for the retention of our legal fees.
Our Lawyer thinks this is possibly the first case where a lawyer has been condemned for failing to do his work properly!
Yup, drinks all round! 😆 We’ve been on the champers all week-end as our son got married on Friday, and then we celebrated his birthday on Saturday. Just gotta open another now..hic!! 😉

wow. I studied law at one point and always like how we studied around actual cases, etc…
one day spanish law students may have to refer to Claire v (dodgy lawyers) 2009.
great news. About time the good guys started winning in Spain, and a middle finger up to those who told us we were wasting our time fighting the system!. A result for Spain as well I feel, as the more cases that go against the bad guys, the more credible Spain will look as a place worth risking hard earnt dosh!.
Out of interest, was the case against an individual lawyer or the firm of lawyers?
Has the lawyer in question been suspended or struck off from practising/their College?
Or is it purely a financial compensation settlement?
Could I just jump in from a position of total ignorance? (Never stopped me before……..)
Knowing the wonderful ways and wiles within which Spain operates (as detailed on this forum ad infinitum) I personally would be very suprised if the settlement would be anything beyond a financial one.

You are correct Dr Robert. It is financial settlement in that we will get what is rightfully ours, which was our intent. More importantly it is a moral gain, against a law firm who thought they could get away with despicable practice.
They have 20 days in which to appeal, so I do not want to say too much now. We can also appeal the verdict.
When it is done and dusted I can say more.
Hillybilly, it was against a named company, specifically the senior partner.
when hopefully you get the agreed sum, it will indeed be more than just a financial settlement. It’s a feather in the cap for all who are fighting to get back what is rightfully theirs. If justice can be achieved like this more often, then it makes anything else unacceptable, which should have been the case for all those cheated since the start of the boom.
