My parents brought a property in Andalucia 4 years ago, having lived in Spain for 16 years already. My father has now died and the property needs to be registered in my mothers’ name only. The solicitor she is using has discovered that the property was never registered in their name and has told my mother to keep quiet for another year as, after 5 years, the property can be registered to her without incurring fines (approx 5000 euros) for it not being done at the time of purchase. Is he correct? Is she right to keep quiet? What are thje repurcussions likely to be if she does nothing for another year? Any ideas welcome…..
