Iam about to sell flat in Benalmadena and have been approached by company which maintains it can reclaim plusvalia.can anyone advise if this is legit and is such a claim likely to succeed,would be grateful for any information on the subject.

Dear John, As a seller you will have to pay plusvalía to the town hall and the buyer has to retain the 3% of the selling Price to be paid to the tax authorities in Spain so you will receive 97% of the selling Price. If you are not making any gain, you will be able to apply for a refund to the Spanish tax autorities of this 3% after deducting all the non resident property imputed income tax of the last 4 years you have been owning the property. thanks for your reply Rachel.I understand 3 per cent retention in respect of plusvalia fiscal.does your answer mean that plusvalia municipal paid to town hall is not reclaimable under any circumstances?
