I own a property on a small complex in Ibiza, during the height of the summer period many of the owners rent out their apartments to tourists. We have public liability insurance, if there was an accident in the communal areas and the tenant was to sue for damages would the the public liability insurance be void because the rental was illegal ?

Also in such a case would the home owners be liable to pay if the case was taken to court ?
