Hi, We sold our house, a finca on 6000 sq mtrs of land, 16 montha ago. the buyer did not want us to take a 10 year insurance. We lived in the house for 6 years with no problems. Now she has denounced us and says the roof needed replacing 6 months ago at a cost of 19448€ and wants us to pay. We have been told even if she didnt want insurance we are liable for this. We are liable for 15 years after the work was done. We had a ‘brit’ do the work and they have gone back to UK. Shouldnt she have come to us before replacing said roof. We have been advised it will cost about 5000€ to go to court to fight this case. We are in the Malaga province. Would appreciate any sound advice.

In my view, and without seeing any documentation, so general speaking, you have many possibilities to win your case at court because:
1º You are not a developer
2º When the buyer bought your house he could check the roof.You can fin a good lawyer and the costs would be less than a half of 5000 eur.
