      Hi, I last posted in 2008 and our situation is still ongoing!

      Did anyone on this forum put down a first stage payment on an apartment in this development or buy it? If so, could you share your story to either give me some hope that a First Occupation Licence may be granted soon or you’ve completed the purchase without it, or even that you’ve won/lost your case against the developer? It would be helpful to know that there are others out there who might be in a similar position to us. Our case was miraculously overturned in 2009, but as yet – no money has been repaid. Bearing in mind the property market at the moment, we are wondering whether just to go ahead and complete on the apartment in the hope the Licence is granted eventually. Would appreciate feedback thank you.

      Janemart, by “overturned” do you mean you won your case against the developer or the Bank using a Bank Guarantee? If the answer is “Yes” to either of these, have you not followed it up with the Lawyer who dealt with the court case?

      Hi Claire, we lost our case against the developer, not the bank, but this judgement was overturned by the High Court of Madrid. Yes, we are following it up, but the Court has not rubber stamped the seizing of assets, even though we are legally allowed to do this now. Every procedure seems to take months and months to implement, it’s awful.

      It would be helpful if there is anyone else involved with the Los Lagos developer that could shed some light on the length of time it’s taking them to get their money back! Thanks

      Congratulations Jane on your win. Brilliant that the first case was overturned.

      2 years is waaaay too long to wait. As I have come to understand it, once you have won your case, the developer has 20 days in which to deposit your money into the court. The procurator then lifts the embargoes or ( I presume,) activates the embargoes and seizes assets.

      I do not know of anyone who has had success against Los Lagos, although I know of many who have had cases against this development. There appear to be far more successes against Green Hills. Problem is, no two cases/outcomes are the same despite the development/problems being the same.

      I would say you need to meet your lawyer face to face and demand an explanation of what is going on and what efforts to date he/she has made to recover your money. Yours is a typical example of everything that is wrong with the so called Spanish justice.

      You MUST keep on your lawyers back until you get some action. There are no excuses for the amount of time you have waited.

      Janemart, I paid a significant deposit at Los Lagos in 2004 but have not done anything about it since as I thought I would be throwing good money after bad. I have logged on today for the first time in many years and just seen your post, and would be very keen to have a chat about the progress – or lack off – at Los Lagos.

      hello, how is this matter going?? are there any news??? I dont want to complete without a FOL, but I don’t know what to do… I feel totally defrauded, I bought through a real estate agency and I dont even know who is to blame for all this disaster…
      I would be very grateful if any one could offer me any help,

      Haven’t posted much on here before, but check in regularly to keep up with what is going on! Depressingly,I have to tell you that we put our initial deposit on a property in Los Lagos de Santa Maria in 2002! Since then it has been nothing but a nightmare which is still ongoing! We are now on our 3rd Lawyer and awaiting our case to be heard in the Supreme Court in Madrid! The wheels of justice in Spain grind very slowly! My advice would be not to proceed without the LFO being in place. If anyone wants to PM me I will go into more detail than I can do on here! The people to blame are the corrupt developers, estate agents and lawyers who formed part of an evil triangle in our case! 😈
