I’m a Briton working in Spain and with Residency.
I’m looking to purchase a used property in Málaga province – I understand that if I were Spanish, this would mean the ITP on the purchase dropping from 8% to 3.5% of the purchase value. Being a working resident without Spanish Citizenship, is this applicable in my case?

Check with a responsible lawyer about the tax. Also, make sure that you get a survey of the property before you buy. The cost of that can be repaid many times over by giving you a list of defects to discuss with the saeller and negotiate a reduction in the price.
