Has anyone got any advice for me?
We bought our villa 2 1/2 years ago off plan. We had a large underbuild and requested that the builder reform this into a 2 bed, 1 bath and lounge area for my son.
We now need to sell an move back to the UK due to ill health .
My estate agent has said that we cannot sell as the underbuild is not on the title deeds and therefore illegal.
We understood that we could sell but the underbuild would not be included in the price.
My solicitor is not interested and said that large properties are not selling anyway.
We are at our wits end.
Any advice would be gratefully rceived.
If the property with its added underbuild complies with the local building regulations you need an architect to submit plans and appy for a licence for the work carried out (Declaración de obra nueva) there will be the cost for the architect and his work, cost for the licence and a charge as a % of the actual or estimated building cost. Once this is done the additional m2 can be added to the deeds.
Again this assumes that the additional m2 complies with local building laws.
Interesting that your solicitor also seems a part time REA.

Can I do this even though the property is under 5 years old. Someone told me that if under 5 years it cannot be added retrospectivey.
