Unfortunately we have an illegal newly built house.
Can any body please tell me if there is any significance in having an architects certificate stating that there was a house on the land before this house which was in good condition which he believes was built there there in 1997/1998.

I am sure that if a finca is built on the same land then you should be able to get the dwelling approved by the town hall

I’m afraid not… that certificate is for the first house not the new one… unless your house is a restoration of the late one…
If that is your situation you can ask your house to be legalized (you wont avoid a penalty fine thought), but if the old house was demolished and the actual one was newly built you’ll have to check with your architect several issues as if it is allowed to build there now; if you have built to the given square meters… it depends on the local planning regulations

That is a dissapointing but not unexpected answer
There are now two houses on the plot which was horizontally divided and altho we have this certificate we are not sure there was not a house there before. When we first saw the plot we were in the yellow zone on the town plans, however, since buying the local council have changed the plans and we are now in the white zone.
