      Hi i have given a spanish lawyer 3000 euros resavation fee because i do not know agent and i do not trust anyone ,So agent said i could give it to there lawyer, l dont think so, So i found a lawyer i hope i can trust him ,time will tell: 😈 estateagent they said it would be ok for me to give him 3000 euros as long as they got comformation of him,Thats a nother story as i had to email 5 times for him to send comformation to them he then email me to say he had done this ,But he did not as the agent said they received nothing, Was told few days for building license still waiting they still saying same old story sitting on someones desk, They then tryed to go behind my back to lawyer to get 3000 euros resavation fee he called me to let me know as they were going to put APARTMENT back on markett,but he did not want to give it as no license and they keep saying to him tomorrow tomorrow i dont think the agent likes him as they say he is mad or maybe they are upsett that they do not hold the resavation fee I called 😈 estateagent thay said they never called him,WHAT A LIE how low can they go to do this after saying that it was ok for lawyer to keep it , They then sent me a email to say he could keep3000 euros resavation and it was no problem,Why can agents put propertys on markett with no building license,?How long does it take for a building license to come through?,How do i find out if i am useing a good agent? 2 months latter building license lost in post still waiting, Does anyone know of lznalloz development near granada ,? developer is called Rudina…..please bear in mind the agent will not return my lawyers calls does it make a different if agent belongs to NAEA ESTATE AGENTS? BY THE WAY BUILDING LICENSE WILL BE HERE TOMORROW But still not, The build is finished in 2007 but im not sure if they will have a building license by then ANYHELP WOULD BE GREAT THANKS FOR THE GOOD SITE : πŸ˜‰ πŸ˜‰

      Hi Bun

      From my own experience……not a good one, I would try to get your 3,000 euro back from your solicitor and wait until the building license is granted. The developer will always say they will sell the property if you don’t put a deposit down. They are the last people you should put your trust in !!! If they do…there will always be another property coming along that you can buy. Trust your own instincts and don’t be pushed. Without a building licence, the developers have nothing to sell. WAIT.

      My husband and I have lost 119,000euro to the developer of an off plan appt we were buying. The licence was revoked 4 weeks after we paid 30% deposit . It was due to be completed by July 2005. It has never been started. The lawyers have swallowed up 7,000 euro “in legal fees” that we paid upfront, for taxes, utilities etc. It is now costing us more money to try and recover this large sum of money.

      thanks claire if id know before this site i would never bought a of plan why can they get away with it Well one good thing is i have signed nothing and a lawyer who is not linked to the agent 😈 holds 3000 resavation on my behalf, but he did ask 1000 euros up front fees, which i hope he has not spent on a good night out πŸ˜› ,I think the agent wants 30%in nov whitch they are not getting with no building licnces,well i hope the lawyer ive got will give me money back, are all spanish developers and lawyers 😈 πŸ˜› untrustworthy why can they get away with it…..Worst thing is ive changed 30% IN TO EUROS as the pound was falling oh well icalled them to day the agent they said they all went for a meeting with the town hall building permit lost so there having to get new one will be nexst week ,i tryed not to laugh what a joke bye for now.,,,,,,,,,,,,,,,, 😈

      Bun, seriously…don’t part with anymore money to ANYONE. I would still be wanting my 3000euro back if I were you. Building licences are either granted ..or not granted. They don’t go A.W.O.L. !!!!!!!!!!!!!!!

      Sounds to me like they are trying it on yet again these agents have no consience,after all the stuff I have read on here I would say to you pull out totally and look for a good resale,its a buyers market as there are lots of apartments available and I have seen more than enough people buying off plan who wanted to sell before completion and cannot.

      How can i find out if the agent im useing is ok πŸ˜‰ or bad 😈 there must be some imformation some were to find out about the good and bad and ,It would be good to find other people on the net who arebuying in to a development, im not buying to sell when finished, we were hoping to keep it if the building licence ever came through,, NOT ,Does anyone hold imformation,wish i could speak spanish as i would be on to the town hall in Iznalloz so i could be one step in front of the agent, WELL we our going to collage to learn πŸ˜‰ bye for now

      If you send me the telephone number of the town hall and the exact details of the project and developer I’d be happy to call their technical department and ask them directly what the situation really is with regard to the building licence, i.e . does it exist or not and if not is there any chance of the developer getting one.

      hello terry thank you for your help well the little i know of spanish i managed to find granada town hall phone number i hope it is 958248239 or 958248126 or 958248225 well i know its the right number but i think it is different departments i hope πŸ’‘ i looked up lznalloz town hall but could not find one, dont know why as it is a small town, well it was untill this developer starts to build 300 apartment but iznalloz is 30 min away from granada so planning should be there i hope but thanks for your help in adva πŸ™„ : πŸ˜› πŸ˜› πŸ˜› πŸ˜› πŸ˜› πŸ˜› πŸ˜› bite more news to make a laugh called a nother agent about development as we all know 1000 developers advertise the same units, this one said oh yes the building licence on that development has been out for 3 months are you sure i said oh yes she said we never sell a development with out a builders licence what a loud of —- bye for now

      Dear Sir,

      Things in the spanish countryside do not work like in the north of Europe, here it is a completely different culture once you go out of big towns or coastal resorts, and you can’t do anything about it.
      So my first advice is don’t panic, most probably nobody is trying to trick you, just be patient , take it easy, but of course that doesn’t mean to seat back and relax….

      You can absolutely trust your spanish lawyer, it is a reputable proffesion in Spain, and of course there are some who are not so honest ( as there are in Great Britain, and for those who don’t believe this just read the Independent newspaper -second half of August- ). Your lawyer there can be more or less efficient but I am sure you can trust him/her. Anyway if in the end you are not very happy with his/her work we can recommend you a good one near Iznalloz ( offices in Granada )

      Learn spanish, adapt yourself to the spanish culture and enjoy Spain.

      Dear Bun,

      I have just spoken to the department of “Urbanismo” in the Ayuntamiento of Iznalloz (Tel: 0034958384051). Currently there isn’t a building licence for this development but it is “en tramite”, i.e. being processed. The drawings, which have already been approved by the College of Architects, are being checked to ensure they meet the Town Hall’s planning regulations and the gentleman I spoke to said there shouldn’t be too much of a delay, assuming all is OK, but he couldn’t give a definite timescale.

      Thanks for all your kind comments but really the call only took a few minutes and at 2p a minute that’s not much. Just interested in seeing what is really happening when people have problems.

      Am off to Fuerteventura tomorrow on business for 2 to 3 weeks but will log on from time to time.

      OK so i have been reading more on this forum as i see about bank guarantees should the lawyer be in receipt of this before first signing and if so should he check with the bank that it is in my name and to be doubly sure is it best for him to send me a copy, So i can check that he is in receipt of it as what i have read on here i think you need to check your lawyer is doing his job ok ❓ , shame really but as i say you can never trust anyone, and yes why dont the spanish goverment clamp down on the buying and selling because surely this is puting people of from buying and in the long term it is bad publicity for them. ❓

      Yes, ideally you need a guarantee in your name, and you need to see a copy.

      Jose Maria Sanchez Alfonso, the lawyer recommended by Mark, would probably know as I believe he is based in Fuengirola. You have to hope he will respond.
      From our own experience, I would not trust anyone 100%. You really do need to do your own homework…even though you are paying for “professional” advice. They all want to sell…at any cost…to the buyer. There are no scruples in this game…so it seems !! πŸ‘Ώ

      Hello forum colleagues,

      I promise I will do all I can to find out about Forum Real Estate, to be honest I haven’t heard of them , there are hundreds of real estate agencies in Fuengirola and around ! surely it is not an important one and anyway I must confess: estate agents in the area normally hate me and you can gess why ……

      I will get back when I have some information, but my advice is if you get a proffesional lawyer in this area you have nothing to fear with any agency or developer.

      There is another Focus in Fuengirola on the seafront close to the fish alley area, don’t know if they are the same company. I think they’ve been there about 12 months, maybe less.
