Hi all im new to the forums and was wondering if any one could help .
I may be going away for 3-6 months working outside Europe what happens if i sell my property in Spain can i just contact a lawyer to do it for me as i dont think ill be able to get to Spain to go to the notary.
Also im thinking of giving it another 6 months then considering a Dación en Pago its been on the market 3 years now to start with the price was maybe high but now i think its at a ok price but still no interest ive allowed to be knocked 10k plus the 6k for agent fees and stuff Its on at 55,000 Euro but ill take 46,000 Euro’s , its finally getting to me ive had to move in with my parents as i cant afford to rent here and pay Spain, ive also pay my bills on time but just cant see a end to it, it’s like im just burning money.
Any advice would be great 🙂
It never fail to amaze me that despite of all the abuse my the solicitors. People want to use them.
Why, would you want to use them you are selling!!!! You are willing to pay thousands to the solicitor but cannot come to Spain one day for the Notary visit ??? Do you think that without you being in your job for a day or two the world will wall apart ????
You need to give him/her a power of Attorney. This will cost you & either come to Spain for this or go to an Embassy in the City that you were going to be taking this job that cannot survive without your absence.
There are cases where the solicitors have pocketed the proceeds of the sale. I sugguest you go through this site in depth & become street wise otherwise you will pay in one form or another.

I did read that you will be out of Europe. The advise does not change. It is your property & your money. I am speaking from experience. I have bought & sold in Spain number of times & without a lawyer & without the benefit of this site.
My purchase has always been in urban area. If you buy in the Country side you will need a lawyer due to various legal issues e.g ownership, illegal build/extensions, outstanding debts, marriages/divorces, unknown half brothers & sisters. These issues are normally not straigt forward when your Grandfather had twelve off springs.
To resolve the above can cost thousands and an open ended time frame. You may have heard the expression ” buyer be aware” not “seller be aware” The majority i.e. the preparation, appoitment with the Notary all can be done by the Estate agent.
It is the buyer who needs a solicitor not the seller. The Bank will send their own representative for cancellation of the mortgage.
