If the developer is some 15 months late in completing a development, and has at no time sought a time extension of the contract, can the contract still be cancelled on the gouunds of breach of contract and would this apply even if the developer has now received the Habitation Certificate
I wouldn’t think you can cancel the contract if the LFO is in place, especially if you have not already started proceedings against the developer. It is not at all unusual for these developments to run way over time…infact it appears to be the norm!
