      Mijas Town Hall has announced the Byblos Hotel is embargoed and will be put up for Auction on 29th July if AIFOS doesn’t pay debts to the Town Hall. Sorry don’t have time to translate more.

      My Spanish is not up to reading Diariosur. 🙁

      If the auctin goes ahead, when it comes to future court cases against them Aifos won’t be able to use the excuse they don’t have any funds to repay purchasers on their illegal builds.

      I just hope that the sale goes through….then as you pointed out they will have no excuse by saying they have no money to pay the people they owe, they have some cheek, I should know it as i have had enough dealings with them.
      As reported in the paper it states that they paid in the region of 40 million for this hotel and I remember it well when they purchased it as at the time we were in and out of court trying to get our money back from them and had to even put an embargo on their account to force them to pay us back what they owed us. All this time they were handing ober 40 million for this hotel…..40 million that they accumilated from me and you and every one else .

      Aifos say that “finally the auction will not take place”.
      Maybe because they know they have the 1,201,356 € tucked away somewhere in one of their many accounts.

      Yes Charlie! You are probably right! They have many bank accounts with a lot of money tucked away in them…..OUR money!
      I had read that also and thought the audacity of them…why do they not just pay what thy owe? but no…they have the money because they do not pay what they owe.
      I just will ask you all …in the present climate where building /selling has come to a standstill where are they getting an income from? are they still selling? building? are they still as they say in business? maybe some of you could fill me in?

      so, Aifos are taking the p**s yet again. They wont pay their debts untill being ordered/threatened by court. You hope that every time they pull a stunt like this, they would be taken less seriously in future cases?

      While they still have assets/money though, i daresay they probably still have more power in Spain than anyone would expect with their reputation!

      still, it sounds like a move in the right direction if at least they are forced to pay debts one way or another?

      Heard on the news that Mijas Council are not expecting the Hotel to go to Auction, just a threat to get some response from AIFOS 🙄 Mijas has offered AIFOS a deal to pay it off at 65,000E per month.

      What suprises me is the speed that the embargo (and subsequent auction) has taken place when many purchasers have been waiting years for their money back.

      in response to goodstich comment regarding them still having influence in Spain…you are right! and why wouldin’t they when probably the majority of people with influence there are in their pockets or are receipients of brown envelopes from them. You can hardly go against them when you have been receiving “gifts” from them for favours rendered.
      In response to Kathy…I agree with you 100%…it takes us years and years to try to get a case heard where as when it comes to the Spanish town hall they can get into court and get their court order or embargo or whatever they want to recover THEIR money in no time at all. One rule for them and another for the ordinary people like us who have propped up the spanish economy by way of buying properties for a very long time.
      It is just all wrong is it not??

      Its like Hacienda and the social security – they can embargo an account without even notification, and within days!

      Something I learned was the embargo on an account is only for that specific day – not until the full amount is paid, so if you are owed 1000 euros and you put the embargo on an account and there is ony 100 euros, then thats all you get. You have to reapply for another embargo even if on the same account! Means dont keep too much in one account I guess!

      Well the auction did take place yesterday of Aifos’ Hotel Byblos after all, but no-one showed up! 😆
      This, despite the reserve of 15 million euros being half the estimated value. Goodness, the market is bad.

      The lack of a buyer now gives the Town Hall the option to sell the hotel to whom they deem fit, and those who are interested in the sale now have six months in which to present their offers. It only needs to recover 1.2 million that Aifos owes in IBI and IAE taxes so this is an absolute (financial) disaster for Aifos. It could end up going for peanuts.

      Anyone interested in forming a syndicate? 😉

      well well, as we have a court embargo on an Aifos property, if we win our case, i’ll stake my claim on this one!………

      …….in reality, we will probably be offered some shitehole two bed appartment in some half built illegal hell hole about 50 miles from the sea!!

      i dont think there’s much chance of a cash settlement?

      The” rats “who deal in auctions will carve up a deal with Aifos and the Town Hall, the Town Hall will get its 1,2 m,the rest of any profit will be shared by Aifos and the “rats”. Aifos will pay nothing to anyone else.

      Nice one Inez! I was only thinking the same myself, Pity there are not enough of us to put up the money to cover the ammount the council want. In regards to Aifos!! the wheel turns and they are getting what they deserve as their greed was what got them in the position they find themselves in.
      My concern and support lies with all the good decent people like Goodstitch who now find themselves having to take them to court to recover his money ….Just like I had to. I do so hope they get a good price for it though only because it will mean that they can not say then in court that they have no money to pay the buyers.I think personally that no matter how much money they get they will hide it away and then plead poverty, they never want to part with a dime….even if it is not theirs to begin with….I should know from the nightmare it was dealing with their solicitors.
      Best wishes to everyone who are trying to recover their money from them…my prayers are with them.!!

      thanks for your kind thoughts. If Aifos get away with continued daylight robbery, i feel it’s because the system lets them. They have enough evidence to bury Aifos a thousand times over. I feel we are fighting a two pronged attack!

      It’s pathetic, but nothing new, have you seen Karens ‘court case’ thread today?

      i agree with you Goodstich!!
      I was just talking to my husband about the latest….no one turning up to the sale and that and he thinks that it was deliberate at there was no one there to make a bid….you and I know that it would be in their best interest if no one turned up as it would delay proceedings. They and their counterparts probably put the word out for no one to turn up, we all know that there are many, many people across all areas in colusion with them the thing is …what happens from here??

      You are right Bettyboo, there is something fishy if no-one turned up. Seems as if Mijas council are somehow involved in the collusion.

      the thing is that it is not only them that have a vested interest in the hotel, you can be assured that many others have put money into that hotel but it is their name up front so if the hotel is sold then there will be a lot of unhappy investors in the backround.

      Still no buyers for the Byblos Hotel, yesterday.

      Mijas Town Hall will survive without their 1.5M.

      I think the Hotel should be donated by the Kingdom of Spain to all the people who have been ripped-off by Aifos & have little chance of getting their money back; some kind of time-share of free holidays for life 😯

      But, would they want to go, after all this?
