…..the problem is that the developers, banks and many Lawyers failed to observe their obligations under LEY 57/68 and acted with a complete lack of professional due diligence.
Hi Keith – you can add judges to that list as well. I know of a case where no BG had been issued and was brought up as one of the ‘arguments’ against the developer. The judge said that not having a BG doesn’t matter now as the building has been built, and dismissed the argument as “irrelevant”!
Needless to say the judge sided with the developer despite a revoked (not temporarily suspended) building licence, no LFO and even awarded their legal costs to be paid by the purchaser when ordering them to complete on something that was officially illegal. Lacking “professional due diligence” indeed.
