For those of you that think we have no sense,let me explain a few things,the main reason this deal went so wrong was because of little or no contact from the agents after we sent the deposit,weeks went passed with no phone calls,e-mail or letters,however we sent over 15 e-mails and tried to contact the agent by telephone leaving messages 6 times,and only after or last e-mail saying forget it we want out,did we get anything from BuySpainProperties,who told us they had been busy and that they had new mobile telephones and that their answer machine was not working.
Within hours of getting the above e-mail the lawyer sent an e-mail saying he would get info to us soon(this has still not arrived),the mortgage co e-mailed saying they had a problem getting the valuation to170,000 euros only 160,000 euros(although the agent told us it was worth 190,00),and they would send a mortgage offer soon(that never came).And the owner then contacted to say that if we wanted to declare the full value the price would have to increase on the house.
As this was all happening only days before the contract said we had to complete the deal,we sent an e-mail saying NO we have had a guts full.
Then within a few hours of the final contract date the owner who had told us he had other cash buyers waiting,e-mailed us to say he would except the offer of 167500 euros with all the furniture and fittings and declare the full value.
As we had still not had anything from the mortgage co or the lawyer,we still said no,because the waters had been mudied.
We then after waiting(3 weeks) for an answer to our request to have our deposit returned.took all the info we had to a UK based legal co for advise and they told us we had done the right thing,we had nothing in any hard copy format.
Yes we in hind sight we did things very wrong but we placed our trust in the agent to do as he said he would.
AS OF THIS POSTING WE HAVE HAD NO REPLY TO LETTERS,E-MAILS OR TELEPHONE CALLS IN OVER 2 MONTHS.RECORDED DELIVERY LETTERS HAVE BEEN RETURNED TO US AND OTHERS,AS THE SPANISH POSTAL SYSTEM TRIED TO DELIVER THEM ON A NUMBER OF OCCASIONS AND EVEN LEFT NOTICE FOR THE AGENTS TO COLLECT.
PHILCO,PHIL@BUYSPAINPROPERTIES,THEN SAYS THE SOLICITORS MUST CONTACT HIM BY TELEPHONE,AS FAR I AM AWARE LAWYERS DO NOT CALL PEOPLE OR SEND E-MAILS,THEY SEND LETTERS(WHICH IN THE CASE OF PHIL @ BUYSPAINPROPERTIES HE NEVER SIGNS FOR OR COLLECTS).
If anybody reading this is thinking about buying from the above agent in Gandia,do not make the same mistakes we made.Also read or posting headed BLACK MONEY.
