      Some Lawyers are advertising to take on your rebate case on a no win no fee basis. Doubt if anyone ever paid it anyway, I never did and I don’t know anyone else who did, properties were going up so fast people just wrote off the 5% retention, if they had paid the full amount due many would have had to pay hacienda hundred thousand or more.

      There could be some bad news for those Brits who take up the claims.

      I know of many cases where the lawyers of these people who had Poder have already claimed back these rebates for themselves.

      A few years back it was a lawyers gravy-train.

      Yes and to add to that I know a chap who sold, collected cash and bought in Spain. His lawyer claimed the tax which alerted hacienda, who then decided there was more to pay as the price of the property was too low in their opinion.

      My pal had a 35k total payment including fine!!!

      Woder of he can claim some of that back no!!!

      A friend of mine sold a property in 2006. The 5% tax retention was paid in Cash by my friend to the Notary in their back office. Upon insistence of my friend a receipt was reluctantly provided and it was my friend who later asked the receipt to be rubber stamped.

      I understand that there is a particular form to record this amount for onward transmission to the Hacienda.

      As this form was not prepared, has the Notary or his back office pocketed the 5% ?????????????????

      If the loop-hole is there, officials will be the first to make it beneficial for themselves.

      I really do hope many ex vendors put in their claims and look forward to the 1,000´s of red faced lawyers explaining their already paid out rebates.

      It is important to add that it will be a minority of lawyers who did this. I know of a vast majority who would never contemplate such things.

      😀 I´m surrounded by them. Seriously though there are some here on SPI who should be singled out for their excellent good work.

      I am often offended when people claim all Estate Agents are bad, when I know they are not all bad. So I have no right to say all lawyers are bad because it simply isn´t true.

      There is nothing more irksome than being labelled dishonest when you have for years turned away from earning a lot of money from bad deals by remaining conciencous and honest. It can make you feel like just robbing the next person that comes along and that is a terrible thing for people to contemplate.

      There are good and bad in all areas of life and therefore no reason to single out lawyers or any other profession.

      This is not a rant BTW, just a full explanation for shakeel

      It certainly didn’t bother a great deal of developers/REA’s on the CDS a few years ago. If only there were more people like you in the property market, Peter. 😀

      Thanks Claire, sadly the half dozen decent agents that I know in my immediate area have or are about to close. Yet those who cannot be named have just opened an office opposite mine, their men in black approach poor holiday makers in the plaza like time-share salemen, it´s quite beneficial as they all cross over to my side of the plaza to avoid them 😀

      Shakeel, yes I know you were just kidding, re the lawyers. Nothing wrong with a bit of fun now and then 😀
