we bought an Aifos property through Ocean View properties, who it looks like are linked to this lot. 5 years later, we are fighting for our deposit back for reasons below.
1- NO BG
2- OVER 4 YEAR BUILD TIME INSTEAD OF 18 MONTHS
3- OUR APPARTMENT SOLD (BY MISTAKE AIFOS SAID!) AFTER NEARLY 4 YEARS, THEY THEN OFFERED US A REPLACEMENT NOT MUCH MORE THAN HALF SIZE WITH NO DISCOUNT!!!
4- 1 POOL INSTEAD OF TWO IN PLANS
5- MORE APPARTMENTS CRAMMED IN TO SAME SPACE
6- SITE ENDED UP LOOKING VERY UGLY (LOCALS RUMOURED TO CALL IT CELL BLOCH H) AND NOTHING LIKE ORIGINAL PLANS.
7- REPORTED PROBLEMS WITH FLOODING/SEWAGE
Although most of above was down to developer, the lawyers Oceanview advised us to use, and Oceanview themselves did nothing to help us. Oceanview even wrote to us, asking us to sign a form for compensation we are owed. We never had that either!!!!, and Oceanview were still advising us to complete even with all the problems. We would not touch either companies again with a barge pole! We have now changed to a decent lawyer who assures us we have a very strong case of several breaches of contract. We are appalled at being treated like this by a UK agent and the uk and Spanish lawyers they recommended. We have been told a string of lies since 2002!.
OVP state that they are an ‘ABTA bonded company’. I’d go to OVP with some serious threats & a time-limit of getting your money back (days not weeks) & then take it to ABTA. They may not want investigations & pay up quickly to keep you quiet ❓ ❓
1. Write to them (recorded delivery) asking that they make good on their promise to return your deposit within 21 days.
2. Take legal advice.
3. If they have breached their contract and you have a case sue!
4. If they have defrauded you call the police and sue!
5. If they have breached their contract and or commited fraud but your legal advisors say you either don’t have a case or the agrivation/risk reward ratio does not stack up, put it down as a learning experiance and move on.
The good news is that in a couple of years the property you thought you were buying will be 20 to 40% cheaper than your current contracted price?

I have since taken our papers to an independent lawyer (who sometimes features on this forum) for her to review. She has alerted us to numerous breaches that we should have been made aware of.
We are now instructing her to represent us with a view to getting our monies back. We feel that this would be a better course than to try and publicly expose them.

Please excuse my ignorance as this is my first post here. In this and other threads, there is some criticism of Ocean View and Ocean Estates. Does this mean there are problems with both companies or have people got the names mixed up? As far as I can see they are not linked to each other are they?
Can someone enlighten me.

She is a good friend to this forum and often gives excellent advice. Her name is Maria de Castro and can be contacted through Costa Luz lawyers. She has given us a first class service and I only wish I had found her (and used her professional) services years ago
