      Can anyone remember the names of the two developments that were taped off by the police in Elviria a few weeks ago?

      I know one development was even emptied of residents (by the police) who had been celebrating the formation of their ‘Resident’s Association’ just the night before (!).

      I know the place, think its named Hacienda Playa, but maybe only one of the blocks. The other blocks were built some years ago (hope they are ok. as I have a few friends in them!)

      I just cannot believe it, what happened? did the police just come in and say the residents all had to leave their properties, or what?
      Where would they go? where will they stay and what will happen to their belongings?. It must be a nightmare for these poor people to find themselves in this appaling situation through no fault of their own. It is the ruthless and greedy developers who go ahead and build without authority and it is the people who suffer as a result. What will happen to these people whose lives and dreams have been ruined be the greed of others?

      I agree! Bettyboo. Its a real disgrace. It’s ALWAYS the innocent buyers that suffer the most, and seem to have the hardest time getting justice!

      I think one of the developments taped off was Las Vistas de Santa Maria beside Los lagos. The other one I think is beside Hacienda Playa – I saw it myself and it is actually sandwiched between two Hacienda Playa phases. We have friends in HP and as far as I know it is fine. In fact our friends are actually looking out onto this other taped off development on what used to be a lovely green space !! I can’t remember the name of the development but it looks totally different to HP (which is very nice) – different colour, different style and different builder – not the same quality at all !! Hope this is of some help.

      It staggers me that they can get to the stage where people have bought and moved into properties before anyone realises there is a problem.
      I know Britain ain’t great, that’s why we’re all looking to get out, but would that happen here?? I don’t think so
      These people must be distraught, potentially losing their homes and hard earned to a bunch of low lifes who can’t be bothered to do things the right way

      Now I am really worried. I bought in Las Vistas and paid deposit of £80k. My lawyers M* are trying to cancel the contract by mutual agreement. Dont know now if I will get my money back. Anyone got their money back from Las Vistas.

      This is the company that is mentioned under a photo of Las Vistas in El Pais. 14-04-2006

      Aspect of works of the houses that promotes the Sur company Sema Investments.

      Moleon/Conmar is a name that crops up in the article. They were the construction company of Santa Maria Green Hills. Jimminez Moleon is on the board of Eralia.

      Hi, can you check your contract and see what is the name of the company appearing on it?

      Also, do you have a copy of the building licence? If not, maybe your solicitor has it. Try & find out who is the owner of the licence.

      These 2 bits of info will probably give us a pretty good idea of what is happening in Las Vistas.

      Thanks. The development is Las Vistas de Santa Maria Golf and the vendor on the contract is Moleon-Conmar, C.B. I have asked my lawyers of the copy of the building licence. I have confirmed with M** who sold me the apartment that is has been fenced off. I have been told that some people have had their deposits returned. I need to confirm this and ask this forum has anybody had their deposits returned. We will have to get together and go to M** and M* to get the money back soon.

      Karen – Have they given any reason for this? Did they ever give you the reason why they refused the mortgage the first time? ie what the urban violation was?

      Laggen, Karen was/is buying at Los Lagos,not La Reserva. I was puzzled as to why the bank would tell Karen about La Reserva and their stance for not giving out mortgages on this development. Maybe because of her banking connections. 😕

      Acornestates, If I were you, I would TRY! and contact the developer directly and DEMAND the return of your money. Agents cannot return your money as they don’t hold it. You should ask them to assist you in this action though as I think they have a duty of care to their clients. if they have any concience at all.( I can answer that for myself 😉 !!).

      Also get your lawyer onto Moleon /Conmar ASAP. He/she also has a duty to sort this out.

      One of my good friends works for a mortgage broker out here, and he has told me that Los Lagos de Santa Maria no bank will touch (rather no decent bank) as it has been built on green zone land…

      The other development in front of Hacienda Playa Phase 4 is the illiegal one, can’t remeber the name, but its something like Pino something or other i think. Also Sabinas del Don Carlos (behind Phase 4) also has some problems and again there are people living in there.

      It is true, one person was “evicted” by police from the development in front of Hacienda. I really don’t know what will happen to them, but i would guess they will fight for their money back…again it also goes to show that you should use a good and reccomended lawyer (not reccomended by the developer) as a good lawyer would have picked up on the fact that it was a project for townhouses, not a 5 storey apartment block!!

      I believe quite a few people have obtained mortgages, from big banks, for Los Lagos. How is it that the banks suddenly wont? If Los Lagos is built on a green zone surely the banks would have found that out before giving a mortgage. 😕 Are they mixing it up with Las Vistas?

      Mtge has been agreed subject to clause which says bank are not responsible if licences are not granted and that if we are paid compensation from Marbella Town Hall or developer we must repay off mtge

      I asked how many other devlopments have been effected and they told me not many but mentioned no mtges at all now at La Reserva

      I only applied for this mtge about 1 mth ago> so I an unable to comment on wheter they were previouaky agreeing mtges without any conditions attached
