I am in a nasty situation whereby I don’t have a BG (my lawyer said the original developer wouldn’t give one!) the original developer sold to a new developer and this new developer also won’t issue a BG according to the lawyer. I have asked the lawyer to give this information to me in writing but he won’t do this. Just to compound the situation, even though the new developer has promised and failed to hand back my money, I am worried that the new developer is in financial difficulties.
If the developer does go bust, how strong would my case be in suing my lawyer for not getting a BG when my contract (that he signed) states that I would have one.?
I am also a bit concerned about changing lawyers in case I let the original one off the hook.
