Cost of reclaiming 3% retention tax

    We used a lawyer(Illagoson)from Marbella for the sale & Inheritance tax  of my late brothers villa who died in 2010! He quoted us €10,800 for his fees “saying this is normal n the Costa del sol,I obtained another quote from another lawyer in Denia quoting €4,800 for the same! When I put this to Illagoson  they reluctantly agreed to price match! I was persuaded by others that we might lose the sale if delays ensued!So we proceeded with Illagoson. We believed that reclaiming the 3% retention tax was part of the same process I.e. Filling in the relevant and paying any outstanding taxes! This lawyer has now informed us that he wants €1200 for submitting tax forms and €2500 for claiming back the 3% retention tax! Can anybody comment on what a fair price would be for this 3% retention tax claim?   John Ward

    Hello, John,
    Re the 3% sales retention, in 2011 I paid €350 (in addition to the conveyancing fee) for a lawyer to submit forms 211 & 212, which he did. Then I was asked to pay another €200 for him to visit the Tax Office in Malaga to get the refund. Nothing happened.
    Last year, I went to another lawyer who charged me €605 following new information provided by the Tax Office in Malaga when I visited them. They now admit that I am indeed due a refund in full but nothing more has been heard from them.
    Hope this helps in terms of cost guidance.
