Bank of Valencia fine

    I have jusy completed the purchase of a property with Proindal in Almerimar. Reservation fee was paid in Jan 2004 and I opened a bank account with the Cajamar Bank. The paperwork was sent to me in November 2005 and I paid 16000 euros deposit. I had opened an account with Solbank in the interim and funds went to the Bank of Valencia, Proindals bankers. When the second deposit was due on 15/1/06 I instructed Solbank to pay the 16000 euros on 13/1/06. The 13th was a friday so funds did not get transferred until 16/1/06, the monday. Unbeknown to me when I signed the peperwork in November there was reference to the second deposit being taken from the Cajamar Bank on 15/1/06. The name of the bank was not shown, only their sort code. When the Bank of Valencia requested funds from Cajamar there were not sufficient funds and their request was denied. This propmted a fine of approx. 1200 euros. Proindal paid this but when I went to complete the purchase on 1/12/06 they would not sign the property over to me until I had given them in cash the 1200 euros. They were aware of this fine for 10 months but never advised me. All the documents were in Spanish and I don’t unfortunately speak the language. I did however have a Spanish solicitor who assured me that the contract was in order and I should sign. Ithought I had done everything that was required of me by ensuring Proindal were paid on time. Have I got to just accept I am unlucky or was either the solicitor at fault for not pointing out Proindal were going to go to Cajamar for th funds or was Prindal at fault for not advising me in Jan 2006 that there was a problem. Or indeed should Bank of Valencia have waived the fine when they realised they had in fact received the 16000 euros, albeit it fro another source. The soilcitor tried to get Proindal to put pressure on Bank of Valencia but they are no longer their bankers and they say they have no clout. ANy comments you have would be very much appreciated.

    Looks to me like you simply failed to fulfill the terms agreed to in the contract you signed. The fine seems rather steep but presumably it was in the contract.
