    Hello Everybody,
    Can anyone offer some help,before we engage solicitors?.
    Here is a brief overview,In 09/06 we visited a number of town houses in Valencia for sale with various agents,and on returning home placed an offer on a property in Villalonga,after paying a holding deposit of 3000euros to the agent things went quiet.
    After loads of phone calls and e-mails,and getting no, hard copies of contracts,answers to black money questions,contact from lawyers or banks,all advised to us by the agent BuySpainProperties in Gandia,we asked the agent to supply the sellers details,which were supplied close to when the deal should have been completed.
    Our reasons for doing so,was due to the lack of legal documents,search reports,mortgage costs,set up fees,valuation reports or anything we could consider legal paperwork.
    After a few phone calls and e-mails to the seller,we quickly found out that black money was at play,we then removed our offer and advised all parties involved in Spain as to our reasons,within hours the agents the lawyer and bank all made contact via e-mail only within hours of each other telling us hard copy had been posted(non of which ever arrived after we removed our offer),and even the seller sent us an e-mail saying he would declare the true value(which we understand was increased after the bank got involved),and we removed the offer.
    However we had already had the waters muddied,and said NO this is as far as it goes.
    We then contacted Solictors in the UK,who looked at the correspondence we had (75% ours 25% from other parties in Spain),and told us we had been taken.
    We then sent e-mails and letters to Phil and Maria at BuySpainProperties in Gandia asking them to advise as there web site says they will do.
    But yet again no in reply over 25 days.We are 3000.00 euros down+our costs and time,and all we can say is that we paid the agent direct and the money must be somewhere.

    3,000 euros is a lot of money to loose, but give yourself a pat on the back for seeing the light and saying “no” to these highway robbers. Many people have lost or are fighting to get back in excess of 100,000euros!

    You should have contracted a lawyer before signing anything and paying anyone. Do you know what you signed?

    I would like to just set the record straight regarding “Shadows” thread….

    “Shadow” did view properties with our company and after returning to England, decided to make an offer on a property we were selling on behalf of one of our clients, well below the asking price, and to include all brand new furniture.

    The price was agreed by both parties, buyer and seller and a contract of compra venta was drawn (with a clause that the 3,000 Euros would only be returned if the property was not legal for sale and if “Shadow” could not get a mortgage on the property) and sent to “Shadow”, which was signed and returned to my company.

    A transfer was meant to be done the next day but was not received into our clients account for a long time. (due to bank???)

    At this point all the documentation was passed to “Shadows” lawyers in Oliva.

    The Lawyer checked all the documentation and advised us it was Ok to pass the 3000 Euros over to the owner.

    Shadow did not want to pay the full 10% deposit until he had a mortgage offer from the bank which the owner agreed.

    After contacting 2 mortgage companies he decided to go with a Spanish lender in Candia and was offered approx 70% of the purchase price.

    He then decided that everybody involved had not being kept in contact with him, he had not been presented with any documents (even though I have an email receipt to say that he has received copies of the escritura etc) and was going to remove his offer and wanted his money back.

    As for the declaration of the property, the owner agreed in the end to sell at the agreed price, totally declaring the property 100% within the date of the contract and after the owner spoke to “Shadow” about this matter, it was clear to the owner that “Shadow” just did not want to buy the property anymore.

    “Shadow” then emailed my company with threats to take me, my business partner or my company to court.
    For 1, we do not have “Shadows” money and 2, as the contract states that everything in the contract was fulfilled, i.e. yes the property was legal, yes he was offered the mortgage, yes the property was free of debt etc.

    We emailed him with the above reply and heard nothing, a few days later we had a call from the owner to say that he had a similar email but instead of taking our company to court, he would be taking the owner to court for the money.

    I heard from the bank a few weeks later to say that they had received no money for the valuation they had done and where going to right it of as a bad debt.

    We have sold many houses in the past and have never had such problems with any clients; we acted professionally and in my opinion over helpful to this client, only to have this happen to us.

    We have copies of all correspondences from the lawyers, banks involved, and ourselves as proof that “Shadow” was kept informed all the way through the process.

    I know this is a long posting, but I would like everybody to know what actually happened and to clear our untarnished reputation as Estate Agents.

    Its good to see the agent (philco) can watch and reply to forums but does not reply to letters or e-mails from customers who have paid them money directly.
    Sure their is always two sides to every story,but I can assure you that I did not want to loose 3000.00 euros just to be apart of a forum.
    Our agent was great before we handed over the deposit,and then little or nothing,and when you read their website look and smile because they say we will guide you all the way,but ask one question! “to what”.
    I have all the e-mails available from all the people buyspainproperties.com sent us and we sent them,good reading I can assure you.
    Do not fall to these people,it will only cost you 😈

    I can arrange that all parties involved with the matter including the Spanish lawyer you were using at the time, Javier from UCI, the owner of the property in question and Maria and I to be there to give your new lawyer the full picture of what has actually taken place.

    Hello again Philco.
    I have sent your last e-mail to our Solicitors in the UK and their Spanish agents in Valencia.
    Only Maria and Phil of BuySpainProperties SLwill need to be available as our claim is after BuySpainPropertis SL and Maria Albuixech and or Phillip Coombes.
    After all you excepted our money into your account and then passed the money to a Lawyer we had never spoken to or had any letters from,and you told us to go to this person,who only replied to e-mail very late at night 2200hrs+ UK time.
    Anyway Philco and BuySpainProperties SLthe Legal system will look at this matter and if I loose 3000.00euros so be it,but I assure you, I will tell everybody who looks at buying from you and Maria at BuySpainPropertiesthey will get my input also,so they can be advised to read into the untruths you give.

    I note again that you have still not given us anything in hard copy,or replied to our last letter of mid Dec 06 sent by recorded post,I also note that all you have done is nothing for us as our agents for over 2 months except reply to forum postings,and advertise the property we have paid a deposit on at a lower cost,although your seller advised he had other cash buyers waiting?.
    I will post other forums,about you and your company and also about the property we wanted and paid a deposit on.
    NB : Get 56 buyers to place holding deposits(as we did) and your selling customer has his house which he did up to sell, will have covererd his costs and made profit and still own it,good business if you can get it and buyspainproperties.com seem to be good at it.

    Yes,keep it in the court system,but the agents do not reply to anything,so how do you take legal action if the agents do nothing?
    We paid a deposit,found a problem asked for advise and then nothing from the agent BuySpainPropertis.com.
    Give me something to go on, as these people do not answer questions ! ,they have our deposit and then say they have given it to a lawyer we have never seen,but was advised by them.

    i can see what you are saying about mud slinging and court, but when a system is as screwed up as it is in Spain, i think it does help people if they can vent their anger and frustration on a site such as this. It also lets other people know what is happening, and if someone else has had a similar problem, they might well be able to offer advice or at least share knowledge. There is two sides to every story and both parties are contributing, so it’s up to the reader to work out the right and wrong of it all. I would think this will end up in court anyway, but i feel it’s very important to get issues like this, as much out in the open as possible. If the whole system had been more transparant from 5 or 6 years ago, alot of people may be in the mess they are now.

    Well lets try a little constructive advice for the Shadow.One getting an independant lawyer.Two don’t pay a deposit until you “know” you have a mortgage and Three don’t give the person you intend to take to court all the material facts you mean to use in your future case.Buying in Spain is simple if you use common sense. πŸ˜‰

    with all due respect, that last comment shows how little is still known about the problems that can and have occured when buying in some parts of Spain. If you spend an hour or two going back through various threads, you will very soon realise there is nothing simple about it, and common sense stands for very little if you are dealing with blatent liars at all levels. I dont expect everyone to see things the same, but please at least accept that there are many people who have used common sense, done their homework and still been well and truly screwed, due to failings out of their control. Believe me it’s not often simple, it’s a minefield. For those buying now, the warnings are clear and pitfalls well documented, that was not the case a few years ago.

    Totally agree in some parts of Spain (Albox etc) Lies have been told.But I was commenting on this thread.Shadow seems not to have exercised much common sense at all.Then because he feels slighted has posted on this board trying to blacken everybody else involved.But given the scant information he has posted the person to shoulder the brunt of the blame is himself.I mean to pay a non returnable deposit when you don’t know if you can get a mortgage πŸ™„

    The drill

    You see an off plan, you pay say €5000 as resrvation and sign a contract say 28 days later.

    You have a choice

    1) Take up builders mortgage ( subrogate) in which case you have to wait until the property is completed, say two years ( if you are lucky)

    2) Get a non builder mortgage, No lender will commit to a mortgage where the draw down will be in two years time. ( I can see why) in the mean time perhaps you have paid 40%

    Thats why I mentioned OFF PLAN, Yes you have option in the case of a re sale.

    But there are probebly more people who bought off plan.

    1. How can I reply to a recorded letter sent by you that I have never received or signed for.!!!!

    2. I have agreed to meet your lawyers, so where is the appointment???.

    3. The property is back on our website being advertised at the original selling price and not at a lower price like you say.

    If you are going to take action against my company, why are your lawyers not contacting me, you must have passed my number to them!!!!

    At the end of the day, you know the vendor received the 3,000 euros, and as you have direct contact to the owner, phone him up and ask him for your money.

    If you read my original posting in this thread you will see that the 3,000 euros was refundable if the mortgage was not approved or the property had debts or legal reasons etc, but the mortgage was approved by UCI, the property was legal and free of debts etc. The contract was in Spanish and accurately translated (on the same document) in English, so Marcus and his girlfriend Denise understood exactly what they were signing.

    Just a quick note to add the following,We sent a letter by recorded delivery to our agent BuySpainProperties.com in mid Dec 2006,asking for contact and replies to e-mails.
    We had this letter returned to us yesterday 02/02/07 after the Spainish Postal service tried to deliver it 3 times and left notice that it was available for collection,but they,as us could not get any reply,so I ask again what do you do if the agent takes your money and runs?.
    BuySpainProperties.com have not made any contact with us in over 2 months but took our 3000.00 euros and said they gave it to a lawyer appointed by them,who we have had little or no contact from.
    Phil and Maria of BuySpainProperties.com of Gandia only want to look after their own interests,buyers beware they will tuck you up,give them nothing until you have something and then ask more questions.

    You are a Conman,the letter returned to us proves this,we and our UK agents have had the same problems,we send letters that you never collect,so you can say things like “HOW CAN I REPLY “only you could say this,but why do you not contact us,by letter on your headed paper,which you have never done?.
    We have the original letters sent to BuySpainProperties in Gandia returned as not signed for or collected,and all sent to your web posted office delivery address in Gandia Spain,maybe we should try to deliver them to your Bulgarian address.

    Dear Readers,
    For those of you that think we have no sense,let me explain a few things,the main reason this deal went so wrong was because of little or no contact from the agents after we sent the deposit,weeks went passed with no phone calls,e-mail or letters,however we sent over 15 e-mails and tried to contact the agent by telephone leaving messages 6 times,and only after or last e-mail saying forget it we want out,did we get anything from BuySpainProperties,who told us they had been busy and that they had new mobile telephones and that their answer machine was not working.
    Within hours of getting the above e-mail the lawyer sent an e-mail saying he would get info to us soon(this has still not arrived),the mortgage co e-mailed saying they had a problem getting the valuation to170,000 euros only 160,000 euros(although the agent told us it was worth 190,00),and they would send a mortgage offer soon(that never came).And the owner then contacted to say that if we wanted to declare the full value the price would have to increase on the house.
    As this was all happening only days before the contract said we had to complete the deal,we sent an e-mail saying NO we have had a guts full.
    Then within a few hours of the final contract date the owner who had told us he had other cash buyers waiting,e-mailed us to say he would except the offer of 167500 euros with all the furniture and fittings and declare the full value.
    As we had still not had anything from the mortgage co or the lawyer,we still said no,because the waters had been mudied.
    We then after waiting(3 weeks) for an answer to our request to have our deposit returned.took all the info we had to a UK based legal co for advise and they told us we had done the right thing,we had nothing in any hard copy format.
    Yes we in hind sight we did things very wrong but we placed our trust in the agent to do as he said he would.
    AS OF THIS POSTING WE HAVE HAD NO REPLY TO LETTERS,E-MAILS OR TELEPHONE CALLS IN OVER 2 MONTHS.RECORDED DELIVERY LETTERS HAVE BEEN RETURNED TO US AND OTHERS,AS THE SPANISH POSTAL SYSTEM TRIED TO DELIVER THEM ON A NUMBER OF OCCASIONS AND EVEN LEFT NOTICE FOR THE AGENTS TO COLLECT.
    PHILCO,PHIL@BUYSPAINPROPERTIES,THEN SAYS THE SOLICITORS MUST CONTACT HIM BY TELEPHONE,AS FAR I AM AWARE LAWYERS DO NOT CALL PEOPLE OR SEND E-MAILS,THEY SEND LETTERS(WHICH IN THE CASE OF PHIL @ BUYSPAINPROPERTIES HE NEVER SIGNS FOR OR COLLECTS).
    If anybody reading this is thinking about buying from the above agent in Gandia,do not make the same mistakes we made.Also read or posting headed BLACK MONEY.

    We are not stupid,philco forgot to tell you the offer of a mortgage came hours after us pulling out of the deal,and waiting 6 weeks for any info about the mortgage which never came,he also forgot to tell you about the black money aspect,but their you go,2 sides to every story.

    I also took the time to read other postings by you and I can only say this”you are very confrontational and stupid you offer no help and give crap advise”,how can you say buying in spain is a gamble?buying property in Spain should be easy as they are members of Europe with a GDP simular to the UK,readers search LATCHY and LOL:,get a life Latchy and bog off from forum sites that try to help people you sad bag of human organs.

    Tetchy πŸ˜† But the fact remains you have done almost everything wrong and then seem to want to blame everybody else.Are we to believe the owner,lawyer and agent all just happen to be crooked? You seem to be very angry and aggresive maybe if you kept your mouth shut and whatever little brains you have in gear this may not have blown up in your face πŸ˜‰ Seems rather than hurl childish insults my way you should be on a flight to Spain to sort your self inflicted mess out. :idea:BTW if you learn to read you will notice when I say buying in Spain is a gamble the reference was in relation to off plan,and sadly for those who leave their brains at the airport buying resale seems to hold the same dangers.

    Within hours of getting the above e-mail the lawyer sent an e-mail saying he would get info to us soon(this has still not arrived),the mortgage co e-mailed saying they had a problem getting the valuation to170,000 euros only 160,000 euros(although the agent told us it was worth 190,00),and they would send a mortgage offer soon(that never came).And the owner then contacted to say that if we wanted to declare the full value the price would have to increase on the house.
    As this was all happening only days before the contract said we had to complete the deal,we sent an e-mail saying NO we have had a guts full.
    Then within a few hours of the final contract date the owner who had told us he had other cash buyers waiting,e-mailed us to say he would except the offer of 167500 euros with all the furniture and fittings and declare the full value.
    As we had still not had anything from the mortgage co or the lawyer,we still said no,because the waters had been mudied.
    We then after waiting(3 weeks) for an answer to our request to have our deposit returned.took all the info we had to a UK based legal co for advise and they told us we had done the right thing,we had nothing in any hard copy format.
    Yes we in hind sight we did things very wrong but we placed our trust in the agent to do as he said he would.
    AS OF THIS POSTING WE HAVE HAD NO REPLY TO LETTERS,E-MAILS OR TELEPHONE CALLS IN OVER 2 MONTHS.RECORDED DELIVERY LETTERS HAVE BEEN RETURNED TO US AND OTHERS,AS THE SPANISH POSTAL SYSTEM TRIED TO DELIVER THEM ON A NUMBER OF OCCASIONS AND EVEN LEFT NOTICE FOR THE AGENTS TO COLLECT.

    If anybody reading this is thinking about buying from the above agent in Gandia,do not make the same mistakes we made.Also read or posting headed BLACK MONEY.

    Dear readers.

    My Office is in the center of Gandia, just 100m from the post office and we get post everyday, if for some reason we are not in the office the post girl leaves any post until the next day and then brings it to our office, so if any recorded mail is not delivered one day, guaranteed we will receive it the next day.

    Also if anyone has visited our site since april 2005 they will notice the same office and mobile telephone number as we have now.

    Telefonica fixed landlines have a built in digital answer phone and only stops working when the mailbox is full.

    It was never said that the property was worth 190.000 euros, if it was, surely the owner who is a builder would be selling the property for 190.000 euros.

    It seems like Marcus has a problem with the Post Office service, lawyers, Estate Agents and Banks in Spain……. AND USING CAPITAL LETTERS IN POSTINGS…..

    You have a mortgage agreed by UCI, all the legal work has been done (that was never paid for), so in reallity you could take possession of the property quickly and then if you do not want to keep it, resale it.

    Please explain Claire.This person seems to have chosen not to follow any of the guidelines on buying property in Spain readily available on forums such as this.And now it has gone pear shaped has thrown his dummy out of his pram and is claiming EVERYBODY else involved in the sale process is negligent or crooked.The only way to buy a property correctly is to sign a presale agreement in a notaries office and BEFORE you hand over your deposit check all the issues such as black money etc face to face with the sellers. πŸ™„

    Six years working for a Madrid based estate agent selling properties to a mainly Spanish/French client base.Never fail to be shocked how often British buyers get it wrong/ripped off (mostly by their compatriots).So no axe to grind with this specific case.Buying in mainland Europe is (should be much simpler than the UK) but……………………………………….BTW Forest looking at your post count since 2005…………..

    OK,Philco,regarding your last posting I would like a copy as per my e-mail to you on the 05/02/07 along with the scaned e-mail sent by you to me telling me you had new mobiles and no answer phone.
    Hope you liked the copies of the letters posted to you showing them as not collected,so they had to be returned.

    OK Phil / Maria.
    Read my last posting,you have still not done as you advised yet again,you could have sent the documents you said on the 5th Feb,as your office is attended 99% of the time,yet here I am again asking you 9 days later for the info you said you would send.
    Spain must have a very poor postal system if it takes 9 days to get a letter to the UK,I could understand the delay if you were sending a postcard,but this is an important document,and you complained that it took me a week to send you 3000 euros which cleared your account in 5 working days.

    Seems to me that Latchy and Philco are offering sensible opinions and advice. ItΒ΄s all happened before. And will happen again as Brits are so daft when it comes to buying abroad. They would never buy a house in the UK without a lawyer and would never buy from a bloke in a bar either, but as soon as they arrive in Spain they behave like muppets.

    By the way blokes in bars selling houses are not estate agents so there goes 50% of the complaints directed at estate agents.

    Philco seems to have done his job adequatley in line with the process as we know it. Shadow was a little remiss in his research to begin with, otherwise he would known black money always exists in resales.

    This case could never get to a court because Philco followed the proceedure and it appears the notary called the completion thus allowing the vendor to keep the deposit.

    Shadow has this put you off buying in Spain??

    Dear Paddy,
    Sorry for late responce but I have been away on business,but I would like to add we did not buy from a bloke in the bar,but went to his office.
    Also as this forum does not seem to be getting us anywere,except that the agent has advised only a few weeks ago that he would forward letters showing where the deposit went and 3 weeks later NOTHING yet again.
    He even advises that we have a mortgage offer and to go ahead and purchase,but we have nothing via e-mail or letter from the mortgage company with the details of the loan.
    So how can we complete? The whole process is very poor,we make an offer,its accepted,we wait for the mortgage offer(which came via a telephone with the request for more money)but still no paper work.
    I am sure Brits make mistakes thats why we us agents,so they can help,but in my case Phil at BUYSPAINPROPERTIES in Valencia has not done this for us as the buyer.
    I will await his reply via this forum,because he never replies to e-mails or letters. πŸ˜₯ πŸ˜₯ πŸ˜₯

    Hi again anybody who has followed this to date,as you can see buyspainproperties have never to this day,made any return contact,and it appears they have set up to offer advise and sing there own praises.
    All who are thinking about working with buyspainpropertis,and their owners Phil and Maria BE VERY AWARE,and do not send them any MONEY unless you want to run the risk of only keeping it by means of illegal practises 😑 😳 😯 .
