    Enrique Bolín wins right to build his skyscraper

    The Junta de Andalucía had left the matter pending with the Mayor of Benalmádena

    The independent Mayor of Benalmádena, Enrique Bolín, has won in court against the Junta de Andalucía, and so can now go ahead with the construction of a 15 story tower block in the centre of Arroyo de la Miel.

    In 2003 the Junta approved the PGOU Urban plan for the town, but failed to agree on lifting the building height limit from the usual four stories for the land involved.

    At that time the land involved was owned by Arenal 2000, a company owned by Rafael Gómez, one of those implicated in the Malaya corruption case in Marbella, but it has since changed hands.

    Left wingers IU say they will take the town planning policy in Benalmadena to the European Court, considering the case of the 15 story block to be ‘a scandal benefiting one builder in particular, who is going to hand back 11 stories of the block for town hall use, in itself worth an extra 5.5 million € to the Ayuntamiento.

    Enrique Bolín was the Mayor who gave a medal to Snr. Penarroya (La Reserva developer, charged with bribary & out on bail in Malaya case) for ‘businessman of the year’ etc.
    Would love to know who the ‘one builder in particular’ they refer to is 💡

    dear oh dear, corruption very much alive and well then, it seems so sewn in to the fabric of business in Spain, i wonder if those of us hoping for change, are just kidding ourselves?

    Think I just may have said ,
    You aint going to change a way of life in this or any country and it will be business as normal albeit in Spain perhaps just perhaps on a lesser scale.
    We just need to keep people informed and this in turn can only help them make informed decisions on their own.

    Don’t be quite so pesimistic yet, Jim.
    The ‘Ecologists in Action’ group did something similar in bringing many undesirable buildings/developments to court successfully and were instrumental in the downfall of the infamous Mayor Gil.

    One of their main areas of success was Elviria!

    The tide is turning – believe me….. 😉

    I agree with you that we ‘need to keep people informed’ but we can make a difference also. It’s the people who stand up and shout “This is not acceptable” who make changes. Otherwise we would still have workhouses, be sending children up chimneys, & living in the bigoted days that the great Oscar Wilde & others had to endure etc. etc. etc.

    quite agree, things only change when enough people have the balls to stand up and say this is not acceptable. I just despair sometimes, but we will keep plugging away at what we know is right!

    Yep as I said the best we can do at the moment is keep as many people informed as is possible and in the distant future things may change a little.
    However I and my advisors are totally in agreement that it aint going to be soon and it would perhaps be foolhardy to think otherwise.
    (we still do the things you say have changed in Torquay) 😀
    As its been said on this forum many times burying your head in the sand
    is foolhardy and if you are bigging up a situation is cause to be removed from the forum.
    Simply cant have rules one way if they dont apply to another?
    However that should never ever stop the fight to try to make changes as without this then they will never happen.
    Same to you with regards to your case and hopefully we can share a glass or two of champers WHEN we win.

    Make it a magnum or two Jim & we’ve got a date 🙂
    I keep having this recurring dream of ALL of us meeting up and staying at the Marbella Club, & partying for days in celebration. As the place was raided this week I think maybe another location would be better. What do you think ❓ I know I am being very premature here.

    No I dont think you are being premature if you feel like I do that I have a case and a good solicitor with bank guarantees.
    I am a stuborn so and so and one way or another I will get a result.

    No BG I am afraid, but as there was an illegal clause in the contract saying I had to pay for it if I wanted one, & they are required by Law to be issued freely, I am not too worried about this. 🙂

    Yep I saw that to and decided to pay for a 100%Bank guarantee on the advice of my solicitor in Marbella who is a personal friend.
    Thought it yet another expence at the time but glad now.

    Jim – out of interest, did they postdate your BG like they did with our one?

    Our (late) Bank Guarantee was dated for over year after than the so-called completion date of our not-built-a brick-for-3-years appt. – so we had to go to court to get it ‘cashed in’ earlier.

    The date was one of the bank’s arguments in court for not wanting to pay – they said we have to ‘respect the law’!

    Luckily the judge threw their argument out of court, and ordered them to pay.
